He was swimming with with his companions while the boat was moored at around 4.10pm on Saturday.
When his friends returned to the yacht they realised he was missing.
Mr Kania's body was pulled from the sea by crew from a passing ship after it was discovered floating in the water around 700 metres from the shore.
Lifeguards used a defibrillator to try and revive him, while police ferried paramedics from the nearby port, La Savina to help him. He was pronounced dead at hospital a short time later.
Mr Marcin is believed to have been drinking and toxicology tests are being carried out to find out if he had taken any drugs.
